TERM OF SERVICE

By purchasing any artwork by me, you are stating that you have read and agreed to the following conditions outlined below.

1. Payment and fees

• Payment can be done through PayPal invoice payments, Zelle (preferably through Zelle) or through Vietnamese bank
• Commissions must be paid 50% upfront and 50% after the final sketch is approved.
• Additional fees will be charge for excessive or major revision in the later stages (more on “revision”)
• Payment must only be sent after I have confirmed your spot and request payment.
• Prices are subject to changes based on the complexity of the commission.Vietnamese
• Có thể thanh toán qua PayPal, Zelle hoặc qua ngân hàng Việt Nam
• Comm phải được trả trước 50% và 50% sau khi bản phác thảo được duyệt.
• Phí bổ sung sẽ được tính vào việc sửa đổi quá nhiều hoặc lớn trong các giai đoạn sau (xem thêm trong “Revision”)
• Việc thanh toán chỉ được thực hiện sau khi đã xác nhận chỗ của bạn và yêu cầu thanh toán.
• Giá có thể thay đổi tùy theo độ phức tạp của comm.

2. Process

• I will notify you, when I start working on your commission.
• While doing the commission, I will update you on the process whether through email or through DM (depending on your preference)
• I will send WIPs (work-in-process) with low resolution and with watermarks.
• The finished product will be sent via email with full resolution and watermarks.
• The commission process may vary 2 weeks – 2 months depending on factors such as the complexity of the work, health, and other business.
• If anything comes up and slows down the process of the initial estimate time, you will be notified immediately.Vietnamese
• Mình sẽ báo cho bạn khi mình bắt đầu làm việc với comm của bạn.
• Trong khi thực hiện comm, mình sẽ cập nhật cho bạn về process qua email hoặc qua DM (tùy theo sở thích của bạn)
• Mình sẽ gửi WIP có độ phân giải thấp và có watermark.
• Sản phẩm hoàn thiện sẽ được gửi qua email với đầy đủ độ phân giải và watermark.
• Comm có thể kéo dài từ 2 tuần – 2 tháng tùy thuộc vào các yếu tố như mức độ phức tạp của comm, sức khỏe và công việc khác
• Nếu có bất cứ điều gì phát sinh làm chậm quá trình ước tính ban đầu, bạn sẽ được thông báo ngay lập tức.

3. Revisions

• You can make a total of 3 rounds of changes to the commissioned work included in the prices, after a third times, additional fees will be charged.
• Changes to the final piece will also be charged with extra fees.
• Changes that I will not count toward the limit/ fees:
- Anatomy errors
-Incorrect/ missing details on my part
- Misunderstanding from my side
- Wrong colors choices from the characters’ reference sheetVietnamese
• Bạn có thể thực hiện tổng cộng 3 lần thay đổi đối với comm đã bao gồm trong giá, sau lần thứ ba sẽ tính thêm phí.
• Những thay đổi đối với sản phẩm hoàn thiện cũng sẽ bị tính thêm phí.
• Những thay đổi mà mình sẽ không tính vào hạn mức/phí:
- Lỗi anatomy
-Chi tiết không chính xác/ thiếu do bên mình
- Sự hiểu lầm từ phía mình
- Lựa chọn màu sắc sai từ character reference sheet.

4. Copyright and usage policy

• I, the artist, retain full rights over any commissioned works.
• By default, I will use the commission as sample for later commissions.
• I reserve the right to post/use the commissioned work in including and not limited to picture, video format on my social network with the following conditions:
- Reduce the quality of the picture.
- Include the watermark.
- Credit you as the owner of the commission
• Commissioned artwork is strictly for personal use only.
• You MUST always credit and/or link back to me when sharing or using commissioned work.
• Neither party has the right to use commissioned works for commercial purposes.
• I do not have the right to print the artwork without any form of consent.
• You can request the commissioned work be private, the whole process, finished product will not be posted in any way.
• You may use the commissioned work in the following ways.
- Make personal, non-profit prints.
- Crop or resize the artwork for use such as avatar (credit still needed)
- Artwork can be used in video given it is not the main subject of said video and includes credit.
- Use the artwork as reference for study.
• You may NOT use the commissioned work in the following ways.
- Claim the artwork as your own.
- Remove any form of watermarks from the works.
- Use the artwork in anyway related to AI generative art, crypto currency, NFT (also applied to me)Vietnamese
• Mình có toàn quyền đối với mọi comm.
• Theo mặc định, mình sẽ sử dụng comm làm sample cho các comm sau này.
• Mình có quyền đăng/sử dụng comm bao gồm và không giới hạn ở định dạng hình ảnh, video trên mạng xã hội của mình với các điều kiện sau:
- Giảm chất lượng hình ảnh.
- Bao gồm watermark.
- Credit bạn là chủ sở hữu comm
• Comm chỉ được chỉ được sử dụng với mục đích cá nhân.
• Bạn PHẢI luôn ghi nguồn và/hoặc liên kết lại với mình khi chia sẻ hoặc sử dụng comm.
• Không bên nào có quyền sử dụng comm cho mục đích thương mại.
• Mình không có quyền in comm mà không có bất kỳ hình thức đồng ý nào.
• Bạn có thể yêu cầu comm được giữ kín, toàn bộ quá trình, thành phẩm sẽ không được đăng tải dưới bất kỳ hình thức nào.
• Bạn có thể sử dụng comm theo những cách sau.
- In ấn cá nhân, phi lợi nhuận.
- Cắt hoặc thay đổi kích thước comm để sử dụng như cho avatar (vẫn cần credit)
- Comm có thể được sử dụng trong video miễn là nó không phải là chủ đề chính của video nói trên và bao gồm cả credit.
- Sử dụng comm làm tài liệu tham khảo cho việc học.
• Bạn KHÔNG được sử dụng comm theo những cách sau.
- Nhận tranh là của bạn.
- Loại bỏ mọi watermark khỏi comm.
- Sử dụng comm theo bất kỳ việc nào liên quan đến AI art, NFT (cũng áp dụng cho mình)

You will be blacklisted if the above conditions are broken in any way.

5. Cancellation and refunds

• You will receive a 30% refund of the original price if the cancellation happens when the commission is 50% completed.
• You will receive a 40% refund of down payment if the cancellation happens after the sketch
• If for any reason I am unable to start the commission, you will receive a full refund.
• If the order is cancelled before I start working on the commission, you will receive a full refund.
• I reserve the right to cancel and refund client’s money at any time if you violates one of the followings.
- Act hateful/ disrespectful.
- Disregard the terms stated in copyright and usage policy.
• I reserve the right to refuse any commission I feel uncomfortable doingVietnamese
• Bạn sẽ được hoàn lại 30% giá gốc nếu bạn hủy comm khi đã được 50%.
• Bạn sẽ được hoàn lại 40% số tiền đặt cọc nếu việc hủy xảy ra sau bản phác thảo
• Nếu vì bất kỳ lý do gì mà mình không thể bắt đầu comm, bạn sẽ được hoàn lại toàn bộ tiền.
• Nếu đơn đặt hàng bị hủy trước khi mình bắt đầu thực hiện comm, bạn sẽ được hoàn lại toàn bộ tiền.
• Mình có quyền hủy và hoàn tiền cho bạn bất cứ lúc nào nếu bạn vi phạm một trong những điều sau.
- Hành động thiếu tôn trọng.
- Bỏ qua các điều khoản được nêu trong "copyright and usage policy"
• Mình có quyền từ chối bất kỳ comm nào mà mình cảm thấy không thoải mái thực hiện
